Dope Fairy Terms of Service

These Terms of Service (“Terms”) govern your access to and use of dopefairy.com (the “Site”), operated by The Holland Seven LLC (“we,” “us,” or “our”). By accessing, using, or purchasing from the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

1. Eligibility

You must be twenty-one (21) years of age or older to access or purchase from the Site. By using the Site, you represent and warrant that you are at least 21 years old, have legal capacity to enter into binding agreements, will comply with all applicable federal, state, and local laws, will not supply products to any individual under 21, and will not misrepresent your age or identity.

We may require age verification and may cancel any order that fails verification.

2. Legal Compliance and State Restrictions

All products sold are derived from federally compliant industrial hemp and contain less than 0.3% Delta-9 THC by dry weight, consistent with the 2018 Agriculture Improvement Act (Farm Bill).

We do not ship to the following states due to restrictions on hemp-derived THCA: Idaho, Oregon, Rhode Island, Vermont, Minnesota, Hawaii, and Utah. Orders placed to these states will be cancelled and refunded.

Due to evolving enforcement, regulatory interpretation, or carrier limitations, we may restrict or refuse shipments to additional jurisdictions at our discretion, including Alaska, Colorado, Montana, Washington (county-dependent), and South Carolina. Legality may change without notice.

Customers are solely responsible for compliance with their state and local laws. We make no representations regarding the legality of possession or use in any jurisdiction.

3. Certificates of Analysis

All products are batch-tested by accredited third-party laboratories. Certificates of Analysis (“COAs”) are linked on product pages or available upon request and may include cannabinoid potency, Delta-9 THC compliance, THCA content, total THC post-decarboxylation, microbials, residual solvents, and heavy metals.

4. No Medical Claims

Products are not intended to diagnose, treat, cure, or prevent any disease. Statements on the Site have not been evaluated by the U.S. Food and Drug Administration. You should consult a licensed healthcare professional before use.

5. Product Use and Customer Responsibilities

By purchasing from the Site, you agree to use products responsibly and as intended, follow all instructions and warnings, not operate vehicles or heavy machinery after consumption, prevent access by minors, not divert or transport products into restricted jurisdictions, and assume all liability for possession and use in your jurisdiction.

We are not liable for misuse, improper handling, or misinterpretation of applicable laws.

6. User Accounts

If you create an account, you are responsible for maintaining accurate information and safeguarding your login credentials. Unauthorized activity must be reported immediately. We may suspend or terminate accounts for violations, fraud, or compliance risk.

7. Order Acceptance and Cancellations

Orders constitute an offer to purchase. We reserve the right to accept, reject, cancel, or limit orders at our discretion, consistent with applicable law, including due to failed age verification, restricted destinations, payment authorization issues, suspected fraud, incomplete or inaccurate information, or compliance, underwriting, or risk concerns.

Additional verification may be required prior to fulfillment.

8. Shipping, Risk of Loss, and Seizures

We ship only within the United States to permitted jurisdictions. Once an order is transferred to the carrier, risk of loss passes to the customer.

We are not responsible for carrier delays, damage, loss, theft, law-enforcement holds, inspections, or seizures. Delivery is not guaranteed in jurisdictions with unstable or inconsistent enforcement. Customers must file carrier claims directly.

9. No International Shipping

We do not ship internationally. Orders routed through freight forwarders or third-party reshippers may be cancelled.

10. Taxes

Customers are responsible for all applicable taxes, duties, and assessments, except where we are legally required to collect and remit.

11. Returns and Refunds

Returns and refunds are governed exclusively by our Refund and Return Policy, which is incorporated by reference. Opened, used, or consumed products are not returnable.

12. Payment Processing

Payments are processed by third-party providers. We may refuse, reverse, or void transactions due to compliance review, suspected fraud, processor requirements, invalid payment methods, or restricted destinations, at our discretion, consistent with applicable law.

13. Intellectual Property

All trademarks, branding, content, images, and digital assets on the Site are the exclusive property of The Holland Seven LLC. Unauthorized use is prohibited.

14. Prohibited Conduct

You agree not to use the Site unlawfully, misrepresent age or identity, purchase for or supply to minors, attempt to bypass state restrictions, scrape, hack, or reverse-engineer the Site, or resell products without prior written authorization. Violations may result in cancellation or termination.

15. Disclaimer of Warranties

The Site and products are provided “as is” and “as available.” All warranties, express or implied, are disclaimed to the fullest extent permitted by law.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, punitive, or consequential damages. Our maximum liability is limited to the amount paid for the product(s) at issue. We are not responsible for legal consequences of possession or transport in your jurisdiction.

17. Indemnification

You agree to indemnify and hold harmless The Holland Seven LLC and its affiliates from claims arising from product use, violations of law, breach of these Terms, misrepresentation of age or identity, or unauthorized resale.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New York. Any disputes must be brought exclusively in state or federal courts located in New York, unless prohibited by law.

19. Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

20. Waiver

Failure to enforce any provision does not constitute a waiver.

21. Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

22. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund and Return Policy, constitute the entire agreement between you and us.

23. Changes to Terms

We may update these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.
